Service Canada Requirements
Once a foreign Caregiver has been identified, the Employer must apply to
Service Canada so that the offer of
employment can be assessed.
There is no fee to apply to Service Canada to assess an application for a foreign
live-in Caregiver, unless the Employer resides in Quebec.
Terms of The Program
When assessing your job offer, Service Canada will primarily review the following:
| 1. |
The job offer must
contain caregiving duties for a child, an elderly or disabled
person in a private household. |
| 2. |
The offered wage
must be comparable to Canadian live-in caregivers based on the
labour market information from Statistics Canada, Service Canada,
provincial ministries, and other reliable sources.
|
| 3. |
The Employer must
provide working conditions that are consistent with federal
and/or provincial standards. |
| 4. |
Sufficient
advertising efforts must have been conducted to find qualified
Canadians or foreign workers already in Canada before applying
to hire foreign live-in caregivers. |
| 5. |
The employment must
be full-time and the Employer is not allowed to share the
Caregiver's services with another Employer. |
| 6. |
The employer must
have sufficient income to pay a live-in Caregiver and he/she
must provide acceptable accommodation in his/her home. |
Validation of Offer of Employment
When the Service Canada has validated your offer of
employment, you will be provided with a letter of confirmation. Your offer
will be sent to the appropriate visa office abroad. If your potential
employee is considered to be eligible for the Live-in Caregiver Program
and meets all other requirements, an Employment Authorization will be
issued.
This may take several months, so plan ahead. Even if Service Canada approves
your offer of employment, your Caregiver cannot work in Canada until he or
she receives the employment authorization naming you as the Employer. SNI
will maintain contact with your prospective Caregiver to determine when
she will be able to begin working for you.
Live-in Caregiver
A live-in Caregiver is a person who is
qualified to provide continuous, full-time, unsupervised care in a single
private household for:
 |
Children |
 |
The elderly |
 |
Persons with disabilities |
Caregiver's Requirements
Foreign live-in Caregivers must meet
certain Citizenship and Immigration Canada criteria before being admitted
to Canada. These criteria reflect the education, language and skill level
necessary for the foreign worker's successful integration into the
Canadian labour market:
| 1. |
Successful
completion of the equivalent of a Canadian high school
education. |
| 2. |
Six months of
full-time training or 12 months of experience in a field or
occupation related to the job you are offering. For example, the
training or experience may be in early childhood education,
geriatric care, paediatric nursing or first aid. |
| 3. |
Ability to speak,
read and understand either English or French. The Caregiver must
be able to function independently in a home setting. |
Employment Authorization
Once the Employer's 'Offer of Employment'
has been validated by Service Canada and sent to the visa office in the
Caregiver's current country, you will receive a copy of it in the mail.
Citizenship and Immigration Canada (CIC) is responsible for determining
whether a foreign Caregiver is eligible to come to Canada under the
Live-in Caregiver Program.
A fee of $ 150.00 Dollars will have to be paid by the Caregiver for the
processing of her application when it's submitted.
Successful Applicants receive an Employment Authorization, allowing them
to work in Canada as live-in Caregivers. After two years of employment,
which must be completed within three years of the Caregiver's arrival in
Canada, program participants can apply in Canada to become permanent
residents. They may be granted permanent resident status provided they
meet certain requirements.
